OzRewardS Terms & Conditions
Site Usage
The terms “the site” or “this site” included within the following paragraphs, refer specifically to all online facilities, including web pages and email services provided by OzRewardS. OzRewardS is wholly owned and operated by Cyberminds Media Pty Ltd, which shall be referred to hereafter as ‘OzRewardS’.
Your access to and use of OzRewardS ("the Website") is subject exclusively to these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website. The completion and submission of the online membership application constitutes the members full acceptance of the OzRewardS Terms and conditions. Membership of OzRewardS is in fact conditional upon a members acceptance and compliance with these terms and conditions, as well as any other notices and/or disclaimers contained within this document and elsewhere on the OzRewardS site and network (referred to here collectively as ‘OzRewardS Terms & Conditions’). Since any member is bound by these OzRewardS Terms and Conditions, it is advisable all members should periodically review them here. Users found in breach of the terms & conditions will have their account suspended indefinitely and may be subject to legal action. OzRewardS reserves the right to change or alter these terms & conditions at any time and for any reason, by providing 30 days notice on this website. OzRewardS also reserves the right to vary the rewards, rates, rules, specifications and conditions of any element of the OzRewardS Service and Network facilities at any time without prior notice. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions.
Membership
Membership is reserved for persons of 18 years of age and over. Persons of 13 years of age or above may join the site with parental or guardian consent. Membership is only available to Australian residents. Only one account and one e-mail address per person is permitted. Only three accounts per postal address are allowed to prevent fraudulent activity. Under no circumstances should an individual join and use the site on behalf of another individual. OzRewardS should be informed immediately of any change to member’s personal details; this includes postal address and e-mail address (changes can be submitted through the member’s personal account). OzRewardS reserves the right to decline membership without explanation. We also reserve the right to terminate your account with OzRewardS at any time, for any reason, without explanation.
Earning Cash & Rewards
With OzRewardS you will have the opportunity to earn cash from a number of our advertisers. We will endeavour to ensure all cash offers are accurately presented. You must be logged into your account and use the links provided by OzRewardS to accrue cashback. As a validated member you will receive cashback as a % of spend, or as a cashback amount for signing up to specific offers as specified within the OzRewardS advertisers directory. The amount of cashback paid by the retailer may be subject to change at any time and for any reason. OzRewardS cannot and will not guarantee that the cashback or percentage cashback amount the member receives will always match that which is advertised. It may in fact be the case that sometimes a higher percentage could be paid due to current retailer promotions.
All transactions entered into with our advertisers, are with that specific advertiser and OzRewardS will not be held responsible for any deficit regarding advertiser’s services and/or products. All disputes should be directed to the advertiser in question and not OzRewardS.
Pending transactions will be confirmed by the advertisers and they will then show as approved in your account details. The speed at which advertisers confirm transactions can vary greatly, but can sometimes be up to 60 days. Whilst we encourage all our advertisers to confirm transactions promptly, we will not be held responsible for transactional delays or advertisers cancelling transactions.
Your account will only be credited once the advertiser/retailer has confirmed the transaction and OzRewardS has received payment.
Should you obtain a refund for goods or services received or should the sale be cancelled for any reason; the cash reward will not be made. Cash payments/rewards will only be made when members log into their account at www.ozrewards.com.au, click on the advertisers link and complete the transaction as instructed (i.e. join the website, complete a purchase, etc). Should you directly visit an advertiser’s website, this will prevent OzRewardS from tracking the transaction back to your account; therefore any reward/payment will not be made. OzRewardS will not be held responsible for any lost or cancelled transactions. All transactions are tracked by the individual retailers using cookies. We respectfully remind members, it is your responsibility as a member to ensure that cookies are turned on with your browser, and that you do not have any internet security software installed on your computer that may block you from receiving the cash back you have earned(i.e. software like Norton internet security may do this). Cookies are required to be enabled on your computer in order for a purchase to be tracked and recognizable by our advertisers as originating from OzRewardS. If cookies are not fully enabled on your computer and your browser is set to reject cookies, it is possible you may not receive all the rewards you have earned. Most computers have cookies enabled; to check yours, go to the tools menu, select Internet Options, and then the Privacy tab. Whilst OzRewardS make every effort to ensure our advertisers report and confirm transactions correctly, we cannot be held responsible for failure to report transactions or incorrectly reported transactions. The advertiser/retailer’s decision is final. It is important to always read the terms & conditions for each retailer/advertiser, as some retailers may require you to complete additional actions before you qualify for the reward/cashback.
If you are using a shared computer (e.g. library or school),
certain cashback transactions may not track back properly. To
prevent this, please use your own computer. Transactions such as
online purchases should track fine, although we make no guarantee.
Payment
Reward payments to members will be paid weekly on a Thursday and 30 days in arrears, provided members have reached the minimum payout threshold of $25.00. Accounts with a balance below the minimum payout level will be carried forward to the following week, until their balance reaches the minimum payout threshold. Payment will be made to members by using Paypal, gift vouchers or cheque.
The signup bonus will be automatically credited to a member's account, immediately, upon completion of the signup process. This bonus will only be paid once per member.
OzRewardS reserves the right to check and confirm member’s identification as necessary and reject and cancel any suspect or fraudulent requests. OzRewardS will not accept responsibility for cheque payments to our members where the member has not accrued at least AUD$25 value. Furthermore, cheques, goods and/or services to our members are solely at the discretion of OzRewardS. Each member agrees by accepting these terms and conditions they are solely responsible for ensuring the accuracy of all information they provide, particularly for the purposes of sending reward cheques. Should a cheque be issued incorrectly (i.e. wrong name) or should a cheque not be received for any reason, an administration fee of AUD$6 will be charged for the cancellation or reissue of that cheque. OzRewardS will accept no responsibility for any mail handling error of any postal service involved in the delivery of your reward cheque. Whilst OzRewardS will make every effort to keep our Network error free, should reward cash be credited to a member due to a programming error or regular essential maintenance, OzRewardS reserves the right to adjust, cancel or reverse such a transaction.
OzRewardS also reserves the right to adjust any cash awarded to members without notice, where an amount has been issued incorrectly due to a computer or system error.
OzRewardS cash payments are not transferable between member’s accounts.
If any advertiser ceases trading, delays a payment or fails to make a payment for any reason, OzRewardS will make every effort to recover any monies owed. We cannot accept responsibility for our advertiser’s failures or successes and until we receive payment from the advertiser, OzRewardS will not guarantee any payments. OzRewardS reserves the right to deduct funds from a member's account should a retailer fail to make a payment. Should any leads or forms be filled in fraudulently or are not completed correctly, the advertiser and/or OzRewardS can invalidate and cancel the application.
We may from time to time adjust your balance upwards or downwards in respect to accounting errors, non-payment from third parties, multiple accounts, and refunds issued, products returned or suspected fraud, for which we have full authority.
Promotions and Newsletters
With OzRewardS membership, members are giving their consent to receive regular promotions and a regular OzRewardS newsletter by e-mail, advising them of the latest special offers and site updates. We will make every effort to keep this commercial advertising material to a minimum; however, we make no
guarantee as to the minimum or maximum number of e-mails you may receive. Members are under no obligation to receive these e-mails and may stop them at any time by terminating their account.
Links to third party websites
All advertisement e-mails sent out by OzRewardS, as well as the OzRewardS site as a whole, contain third party advertising which could include embedded hyperlinks to other websites operated by third parties, that are controlled and maintained by others or their licensees or contractors. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that OzRewardS are not responsible for the content or availability of any such sites. All third party advertisements have been paid for by the specific third party advertiser and are not in any way endorsed or recommended by OzRewardS, its affiliates or their respective directors or employees. All members are respectfully referred directly to the relevant retailer for any information regarding their advertisement/s or the advertiser’s products and/or services. Sometimes certain advertisements will contain representations or offers by the third party advertiser which a member can accept by linking to the advertiser’s website and completing the relevant transaction. As a member of OzRewardS, you acknowledge that such offers are not made by OzRewardS.
Dormant Accounts
Should your account not be used for a minimum period of 90 days, we reserve the right to suspend and terminate your account without notice and any outstanding payments would be automatically forfeited.
Terms & Conditions Amendments
We reserve the right to change/modify any of the terms and conditions contained within this agreement, at any time and in our sole discretion. Members will be notified when/if these changes take place by e-mail and by a posting on the OzRewardS website terms & conditions.
Miscellaneous
This agreement is governed by Australian law, without reference to rules governing choice of laws. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
Fraudulent Transactions
If a member enters false details with any of our advertisers or attempts to fraudulently obtain money from our advertisers for whatever reason, your
account will immediately be suspended, all outstanding rewards/monies will be automatically forfeited and the relevant authorities will be notified.
Site Abuse/Misuse
This site is provided on an 'as is' basis, and we cannot guarantee continuous service. If you attempt to defraud the site www.ozrewards.com.au in any way, we reserve the right to terminate your account without notice, withdraw our services and pass your details to the relevant authorities. Again, any outstanding cash/rewards will be automatically forfeited.
Anti Spam Policy
www.ozrewards.com.au encourages you to refer friends and family to the site, by sending them e-mails promoting the site. In turn, you would get the potential to earn additional cash reward for this referral. This process could be used for spam or spamming activity and if this is discovered, the member concerned would have their account immediately suspended and/or terminated without prior notice.
Account Suspension/Deletion
Should it be deemed necessary to suspend or delete your account for any reason, any outstanding earnings, either pending or approved will automatically be forfeited. Your account will only be suspended should you be suspected of fraudulent activity or be found to be breaking these terms and conditions. Our decision is final.
Our Advertisers
We would encourage you to be a regular user of our site and would like you to conduct your entire internet shopping through OzRewardS. We will not, however, accept users clicking on the same advertisers multiple times to enhance their financial rewards. Our advertisers have invested in sophisticated software that will notify them immediately of duplicate applications for loans, finance, etc. OzRewardS will also not accept applications in the name of friends or family. This will result in your account immediately being terminated and all earnings will be forfeited. Should you lodge an application, and then decide the product does not suit your requirements and cancel, this would be considered acceptable practice. In the future, your circumstances may have changed and you may then wish to reapply to see if that companies criteria now suits your specific requirements.
We do not accept advertising from: Adult pornographic sites, Drug sites, with illegal or objectionable content, any site and or network engaged in TheftWare, Hijacking, and or Blockers, and sites that are political or have strong controversial views.
Personal Income
Members of OzRewardS are responsible for their own taxation affairs.
Disclaimer of Warranty
As an OzRewardS member, you agree & acknowledge that you have not relied upon or been induced by any representation by OzRewardS and OzRewardS makes no warranty or representation as to:
· The goods and/or services purchased or obtained through OzRewardS, including goods and or services offered by third party retailers/advertisers, except where expressly indicated;
· the results that may be obtained through membership of OzRewardS;
· the financial or other rewards which may be obtained through membership of OzRewardS;
· the service or network being uninterrupted, timely or error free;
· The accuracy, reliability or otherwise of any information obtained through membership of the service.
Pages on the OzRewardS site may also contain information on investments. No such information should ever be taken to constitute financial advice. However, if anyone decides subsequently to make real investments based on information on the OzRewardS site, they should be aware that such investment carries financial risks, and that the value of shares can go down as well as up and that past performance carries no guarantee of future performance. Anyone considering investments should consult an appropriate Financial Adviser.
OzRewardS accepts no liability for any losses incurred by those investing on the basis of information displayed on this site. Furthermore, no guarantees can be provided as to the accuracy of any information contained on the site.
OzRewardS makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
Limitation of Liability
As a member of OzRewardS you agree to discharge OzRewardS and its officers, employees, subsidiaries, agents, and affiliates from any claim for loss, damage or liability, including special indirect or resulting loss or damage such as loss of income, unavailability of systems or loss of data, in respect of:
· any advertising emails forwarded to the member;
· membership of OzRewardS;
· the members use of or inability to use the OzRewardS site;
· Any disagreement with a supplier of goods and/or services;
· The quality of goods and/or services purchased by the member.
OzRewardS the Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
Indemnification
All OzRewardS members agree to indemnify and keep indemnified OzRewardS and its employees, officers, subsidiaries, agents and affiliates against all claims (including third party claims), losses, demands, legal fees, costs, damages, penalties or suits arising out of or as a result of the members use of the service or the network.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the law of the Commonwealth of Australia and laws of the state of South Australia. As an OzRewardS member you hereby submit to the exclusive jurisdiction of the Courts of the Commonwealth of Australia as well as the courts of South Australia.
These terms and conditions should be read in conjunction with the OzRewardS privacy policy.
Severance
If any of these Terms and Conditions should be determined to be unacceptable, unlawful or unenforceable for any reason by any court of competent jurisdiction then the specific Term or Condition shall be severed and the remaining Terms and Conditions shall survive and continue to be binding and enforceable.
Copyright
All copyright, trade marks and all other intellectual property rights contained within the OzRewardS Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to OzRewardS or otherwise used by OzRewardS as permitted by Australian law.
In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, transmitted, reproduced, copied, sold, distributed or stored, without the prior written consent of OzRewardS as the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.
